This Privacy Policy (this “Policy”) describes how Cathay Bank and its affiliates (“Cathay Bank”, “we,” “our,” or “us”) collects, uses, and discloses personal information that Cathay Bank obtains through our website (the “Site”), our mobile application (the “App”) and other online resources (collectively, the “Services”).

As used in this Policy, the term “personal information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household. Personal information does not include information that is publicly available, de-identified, aggregated, or anonymized, or otherwise exempted by law.

 

1. Sources of Personal Information

We may collect personal information from a variety of sources, such as:

  • Directly from you and other consumers through your interactions with and use of our Services, including when opening an account; applying for a loan; providing employment or income information; and submitting information through electronic forms.
  • From public sources of data, including government agencies, public records, and websites.
  • Automatically through our Services, including through automated technologies and online browser tools, such as cookies, pixel tags, and other technologies.
  • From service providers, business partners, or other third parties, including advertising networks, data analytics providers, and financial practitioners.

From time to time, we may use or augment the personal information we have about you with information obtained from other sources, such as public databases, fraud detection services, and other third parties. We may also combine information we obtain from another party with information we already have, and we may combine information that we have collected offline with information we collect online.

If you choose to submit any personal information relating to other people, you represent that you have the authority to do so and permit us to use the personal information in accordance with this Policy.

 

2. Personal Information We Collect

The specific pieces of personal information that Cathay Bank collects, uses, and discloses depends on the Services you have or use with us. We collect the following categories of personal information:

  • Identifiers and Personal Records, such as name, email address, address, phone number, emergency contact information, Social Security number, Driver’s License number, Tax Identification number, and signature.
  • Financial Information, such as Cathay Bank Account information, credit/debit card number, account balances, credit history, investment activity, income or source of funds, and payment/transaction history.
  • Professional or Employment Information, such as occupation and title.
  • Characteristics of Protected Classifications, such as age, date of birth, gender, ethnicity, military or veteran status, marital status, sexual orientation, and familial information.
  • Geolocation Data, such as your location inferred from your device IP address.
  • Internet or Other Electronic Network Activity Information, such as browsing history, IP address, device type, operating system, and duration of user session, and information regarding your interactions with our Services.
  • Contents of Communications, such as when you send us an inquiry or make a complaint.

In addition to the above categories, you may choose to provide us with additional pieces of personal information when you add information to your Cathay Bank Account, use Cathay Bank Services, or interact with us in other ways.

 

3. How We Use Personal Information We Collect

We may use each of the categories of personal information listed above for the following business purposes:

  • Fulfillment and Responding to Requests. We may use personal information to fulfill your requests and perform our responsibilities under our contract with you, such as opening your account and providing the location of the branch nearest to you.
  • Protection and Security. We may use personal information to protect the security and integrity of the Services, and for the protection of Cathay Bank, our users, and others, such as protecting our Services from cyber risks; authenticating users; enforcing our policies and terms; protecting our rights; fulfilling our legal obligations; and generally safeguarding our Services.
  • Responding to your Inquiries. We may use personal information to respond to your questions, complaints, and other communications.
  • Payment Processing. We may use financial information to complete requested transactions.
  • Administrative Communications. We may use personal information to send you important information regarding our Services, such as changes to our terms, conditions, and policies and/or other administrative information.
  • Advertising and Marketing. We may use personal information to show you more relevant and meaningful content based on your interests, including notifying you about our promotions, offers, and programs; inviting you to participate in surveys; serving advertisements; identifying usage trends; and determining the effectiveness of our promotional campaigns.
  • Research. We may use personal information to conduct research and surveys, compile databases, and identify individuals to recruit in research programs.
  • Improve the Services. We may use personal information about how you and other users interact with our online Services through the Site, the App, and online tools in order to compile statistics for analysis of our Services and business, development of insights to improve our Services, and provide our users with enhanced features and functionalities.
  • Internal Business Purposes. We may use personal information collected from the categories listed above for our internal business purposes, such as data analysis, audits, developing new offerings, furnishing the Services, improving our Services, identifying usage trends, and determining the effectiveness of our promotional campaigns.
  • Legal and Regulatory Purposes. We may use personal information to comply with our legal or regulatory obligations, such as managing risks, investigations, reporting, and other compliance activities; complying with anti-money laundering procedures; tax reporting; preventing fraud, suspicious, or other illegal activities; responding to court orders or other government and law enforcement mandates or requests; or identifying, supporting, or defending actual or threatened legal actions, claims, defenses, or declarations in a case or before any jurisdictional and/or administrative authority, arbitration, or mediation panel; and enforcing compliance with applicable laws, regulations, or legal processes as well as industry standards and our policies.

We may aggregate and/or de-identify personal information, as permitted by law, and use it for any purpose, including product and service development and improvement activities.

 

4. With Whom We Disclose Personal Information

We may disclose certain categories of personal information listed above with the following categories of recipients for business purposes consistent with our purposes for collection outlined in this Policy:

  • Affiliated Entities. We may disclose your personal information to our subsidiaries and corporate affiliates, such as the Cathay Bank Foundation. These companies may use your personal information consistent with this Policy.
  • Service Providers, Vendors, and Professional Advisors. We may disclose personal information to service providers, vendors, and professional advisors to assist with running our everyday business, such as account maintenance, data analysis, online advertising, payment and credit card processing, infrastructure provision, IT services, customer service, email delivery services, mobile application providers, and other similar services. We work with auditors, administrators, legal and tax advisors, IT consultants, software companies, and other entities.
  • Commercial Partners. We may disclose personal information to unaffiliated third parties and other financial companies who partner with us to deliver the Services or for other commercial activities. Depending on the choices you have made, such as intentionally directing Cathay Bank to disclose your personal information to other financial companies, and the nature of the joint marketing or joint activity, these third parties may contact you regarding Cathay Bank-related programs, services, and promotions that may be of interest to you.
  • Business Transfers or Assignments. In the event of any reorganization, merger, sale, joint venture, assignment, transfer, or other disposition of all or any portion of our business, assets, or stock (including without limitation in connection with any bankruptcy or similar proceedings), we may transfer any and all personal information that we collect to the entity with whom any of the aforementioned dispositions is occurring.
  • Law Enforcement; Emergencies; Compliance. We may disclose personal information about you to others as we believe to be appropriate: (i) under applicable law including laws outside your country of residence; (ii) to comply with legal process (iii) to respond to requests from public and government authorities, including public and government authorities outside your country of residence; (iv) to enforce our terms and conditions; (v) to protect our operations and property interest; (vi) to protect the rights, privacy, safety, or property of Cathay Bank, our employees, users of our Services, you, or others; and (vii) to permit us to pursue available remedies or limit the damages that we may sustain. We have no obligation to notify you of such disclosures, except as required by applicable law.
  • At your direction. We may use and disclose your personal information as you otherwise consent. For example, if you enter a promotion, the official rules may include provisions related to the disclosure of personal information.

Cathay Bank may also disclose aggregate or de-identified data that is not personally identifiable to third parties for any purpose.

 

5. Cookies and Other Tracking Technologies

We and our vendors (including analytics providers) may use a variety of tracking technologies, including cookies, beacons, pixels, SDKs, and APIs, that automatically or passively collect certain information whenever you visit or interact with the Services. Depending on your device and browser settings, these tracking technologies may collect your IP address, device identifiers, user preferences, geolocation, the pages you click on, and the website you visited immediately beforehand.

We may use these technologies for various purposes, including to provide functionality, help us route traffic between servers, understand how the Services are performing and how visitors use the Services, improve features and content, and provide advertising. We may combine certain information collected through tracking technologies with other information we obtain about you, which may include information we obtain from our vendors. We or other parties may collect personal information about your online activities over time and across different devices and websites when you use the Services.

We may engage web analytics service providers, such as Google Analytics, to help us understand and analyze how visitors interact with our Sites. We use such data to administer and improve the quality of our Services and serve ads on our behalf across the Internet. We have also implemented Google Analytics Advertising for features such as audience targeting, user segment analysis, device reporting, and display advertising. Please note that Cathay Bank has enabled restricted data processing for Google, which restricts the way Google can use certain unique identifiers and other data processed to undertake certain activities.

Certain technology vendors we engage offer additional information about how they process personal information and tools that you can use to limit or opt out of certain processing:

  • Google. For more information on how Google Analytics uses data collected through the Site or to opt out, visit: policies.google.com/technologies/partner-sites. To opt out of Google Analytics cookies, visit: myadcenter.google.com or tools.google.com/dlpage/gaoptout.
  • Meta. Meta may use cookies, web beacons, and other storage technologies, including the Meta Pixel, to collect or receive information from the Site and elsewhere on the internet and use that information to provide measurement services and target and deliver ads. To change your privacy and advertising settings with Meta, log in to your account and navigate to your account settings.
  • Facebook Custom Audiences. You may opt out of Facebook Custom Audiences by logging into your Facebook account and changing your privacy or advertising settings as per Facebook's opt out instructions. Please note that we do not control how other parties manage their opt-out processes.
  • YouTube. For more information on how YouTube uses data, visit: www.google.com/policies/privacy.

Certain advertising tracking technology vendors may participate in the Digital Advertising Alliance (“DAA”) and its AdChoices opt-out program or the Network Advertising Initiative (“NAI”). For more information about opting out or to use the DAA opt-out tool visit youradchoices.com/ (for web browsers) or aboutads.info/appchoices (for mobile apps). For more information about opting out or to use the NAI opt-out tool, visit networkadvertising.org/choices/ (for web browsers) or networkadvertising.org/mobile-choice/ for (mobile apps). Even if you are able to opt out of certain kinds of interest-based ads, you may continue to receive non-targeted ads.

You may set your browser to notify you of or decline the receipt of tracking technologies; however, limiting the ability of website technologies may limit your experience and, in some cases, the Site may not work. Your web browser may have settings that allow you to transmit a “Do Not Track” signal when you visit various websites or use online services. Like many websites, our Site is not designed to respond to “Do Not Track” signals received from browsers.

We are not responsible for the effectiveness of, or compliance with, external-parties' opt-out options or programs or the accuracy of their statements regarding their programs.

 

6. App Disclosures

We may disclose your personal information as described in the “With Whom We Disclose Personal Information” section above. To the extent we provide external parties access to your personal information obtained through our App, we require that they provide the same level of personal information protection as required by this Policy.

Depending on your device or App permission settings, the App may have access to the following information from your mobile device:

  • Contacts. The App may have access to your contact information.
  • Location. The App may have access to your precise or approximate location.
  • Stored information and photos/media/files. The App may be able to read, modify, or delete the contents of your USB storage.
  • Camera. You may allow the App to take pictures and videos.
  • Wi-Fi connection information. The App may view your Wi-Fi connections to connect and disconnect from Wi-Fi.
  • Phone. The App may directly call phone numbers.
  • Other information. For example, the App may be able to receive data from the Internet, prevent your device from sleeping, your network connections, and obtain full network access.

These App permission settings allow you to access or use certain features within the App. For example, in order to locate the nearest branch to you, the App may need access to your precise location. You may change your App permission settings. By changing your App permission settings, you may affect your ability to access or use certain features on the App.

Additionally, you may be able to log into the App using your device’s log in features such as using a passcode or your fingerprint. These device log in features are facilitated through your device and not Cathay Bank and we have no control over such features, which you can change by accessing your device settings and preferences.

You can use mobile device settings to limit mobile tracking technologies and associated activities. For instance, you can adjust or reset the advertising identifiers on your mobile device in the device settings. iOS users can visit Settings > Privacy > Advertising > Reset Advertising Identifier. Android users can visit Google settings > Ads > Reset advertising ID.

If you no longer wish to provide your personal information through our App, you may uninstall our App from your device. Note that this action will not delete your user account or any information we previously collected via the App, nor does it affect our personal information collection through our other Services.

 

7. How Long We Retain Personal Information

We will store your personal information for no longer than is necessary for the performance of our obligations or to achieve the purposes for which the information was collected, or as may be permitted under applicable law. To determine the appropriate retention period, we will consider the amount, nature, and sensitivity of the information; the potential risk of harm from unauthorized use or disclosure of the information; the purposes for which we process the information and whether we can achieve those purposes through other means; and the applicable legal requirements. Unless otherwise required by applicable law, at the end of the retention period we will remove personal information from our systems and records.

 

8. Security and Protection of Personal Information

We have put in place reasonable technical and information safety safeguards that comply with federal law in order to protect your personal information from unauthorized access and use.

While it is our practice to take reasonable steps to secure the Services, the confidentiality of information transmitted over the Internet cannot be guaranteed. We urge you to exercise caution when transmitting personal information over the Internet, especially personal information related to your financial information.

 

9. External Websites

This Policy does not apply to external websites to which Cathay Bank may link.

If you are a customer of a financial product or service offered by one of our service providers, that service provider should also have delivered to you a privacy notice that explains how they collect, use, and disclose information about you and offers you certain choices with respect to the use and sharing of your personal information.

 

10. Children and Minors

Our Services are not intended for, not directed to, individuals under the age of thirteen (13). We do not knowingly collect personal information from children under the age of thirteen (13). If we become aware that we have received Personal Information from a person under the age of thirteen (13), we will delete the information in accordance with applicable law.

 

11. Your Choices

Account Information. You may update certain personal information by logging into your account and accessing the account settings feature.

Email Marketing. If you no longer want to receive our promotional email communications, you can unsubscribe by clicking on the “unsubscribe” link found in our commercial email messages. If you opt out of our promotional emails, we may still send you email messages related to your account or any Services you request from us. Unsubscribing from our promotional emails will not affect the level or quality of service we provide to you.

 

12. Additional Information for California Residents

This section is provided pursuant to the California Consumer Privacy Act (“CCPA”) and applies to personal information we collect about California residents through the Services and in other contexts, including offline.

The disclosures in this section apply to our current practices, as well as our activities in the twelve (12) months preceding the Effective Date.

Personal Information We Collect, Use, and Disclose

We may obtain the personal information listed in the “Personal Information We Collect” section above from our Services and offline sources, such as from our branch locations. In addition to those categories of personal information, we may collect the following personal information from online and offline sources:

  • Personal Information Described in Cal. Civ. Code § 1798.80(e), including name, signature, address, telephone number, education and employment information, or employment history.
  • Audio, electronic, visual, or similar information, including security camera footage and audio recordings of customer service calls.
  • Inferences drawn from the above categories of personal information reflecting your preferences, characteristics, behaviors, attitudes and abilities.

Your California Privacy Rights

If you are a California resident, you may have certain rights regarding our processing of your personal information. We will process your request as soon as reasonably practicable, subject to legal requirements.

  • Right to Know. You have the right to know the categories of personal information and/or the specific pieces of personal information we have collected about you, including: the source of your personal information; whether your personal information is sold or disclosed; the purposes for which we collect, sell, share, or disclose your personal information; and the recipients to whom we sold, shared, or disclosed your personal information.
  • Right to Delete. You have the right to request deletion of personal information we collected from you, subject to certain exceptions.
  • Right to Correct. You have the right to request that we correct inaccurate personal information we retain about you.
  • Right to Non-discrimination. We will not discriminate against you because you choose to exercise your privacy rights.

We do not sell or share the personal information of California residents, as defined by the CCPA. We do not collect and or use sensitive personal information for any purpose to which the right to limit use and disclosure applies under the CCPA. We do not use sensitive personal information to infer characteristics about California residents.

Some of the personal information collected and processed by Cathay Bank will be out of scope for certain individual rights as it falls under exemptions for information collected under applicable federal laws. For example, nonpublic personal information that is collected from an individual who obtains from us financial products or services to be used primarily for personal, family, or household purposes is not subject to aspects of various jurisdictional privacy laws, including the CCPA. Exercising Your Rights

You may exercise any of the applicable rights described in this Policy You may exercise any of the applicable rights described in this Policy using our request site’s Submit a Personal Information Request or calling 800-922-8429. We will promptly respond to all applicable requests.

We reserve the right to verify your identity in connection with any requests regarding personal information to help ensure that we provide the personal information we maintain to the individuals to whom it pertains, and allow only those individuals or their authorized representatives to exercise rights with respect to that information. If you are an authorized agent making a request on behalf of a consumer, we may require and request additional information to verify that you are authorized to make that request.

We reserve the right to deny your request if we cannot verify your identity. Where we deny your request in whole or in part, we will endeavor to inform you of the denial, provide an explanation of our actions, and the reason(s) for the denial.

We will not restrict or deny you access to our Services because of choices and requests you make in connection with your personal information.

California’s “Shine the Light” Law

Under California's “Shine the Light” law, California residents are entitled to request certain information regarding our disclosure, if any, of certain categories of Personal Information to third parties for their direct marketing purposes in the preceding calendar year. Note: We do not share personal information with third parties for their own direct marketing purposes without your consent or providing the ability to opt out.

 

13. Changes

We reserve the right to amend this Policy at any time. When we do revise this Policy, we will update the Effective Date at the top of this page so that you can tell if it has changed since your last visit. The effective date of this Policy is the date in which this Policy was last updated. Your continued use of our Services constitutes your acceptance of the terms of the Privacy Policy as amended or revised by us from the date this Policy was last updated.
